1. Important Notice
These Terms and Conditions apply to all sales, quotations, and website use through Future Fence Pty Ltd unless otherwise agreed in writing. All quotations and product information provided through this website or by Future Fence do not constitute building, engineering, compliance, or certification advice and must not be relied upon for construction or regulatory approval. All building, engineering, compliance and certification matters remain the sole responsibility of the Customer.
The Customer must not rely on the skill or judgement of Future Fence in relation to the suitability of the Products for a specific purpose. Any advice, recommendations, allowances, provisions, information, or assistance provided by Future Fence is given in good faith and without liability, relying on the accuracy and completeness of information provided by the Customer.
2. Quoting Limitations
Future Fence has not conducted a site visit and has therefore not considered site-specific factors such as soil or substrate suitability, wind rating, topography, access constraints, or finished ground levels.
While reasonable efforts are made to accurately reflect supplied measurements and site layouts in manually generated quotes, Future Fence accepts no responsibility for any errors, misinterpretations, or omissions relating to dimensions, elevations, or positioning. The Customer is responsible for confirming the accuracy of all site-related details.
Future Fence has not assessed or verified compliance with the National Construction Code (NCC), Building Code of Australia (BCA), state or local planning requirements, or any Australian Standards including AS1926.1 (pool fencing), AS1170.1 or AS1657 (balustrades and structural loads).
3. Customer Responsibilities
By proceeding with purchase or installation, the Customer and/or their installer acknowledges that they are responsible for obtaining independent engineering and compliance advice (if and where relevant) before installation.
All installations must comply with applicable laws, codes, and manufacturer instructions. Future Fence accepts no liability for installation errors, damage, or non-compliant use of its products, including situations where Future Fence has introduced the Customer to an installer.
The Customer is responsible for ensuring that all necessary building approvals and certifications are obtained. The Customer indemnifies and releases Future Fence, including its owners, officers, employees, agents and assigns, from any claims, losses or damages arising from unauthorised or incorrect use, installation or modification of Future Fence products.
4. Product Limitations
Balustrades: Future Fence panels are not designed or certified for use as balustrades or in any application requiring a load-bearing or fall-prevention barrier. Use of Future Fence products in such applications is strictly prohibited.
Fixings: Fixings are not supplied unless otherwise stated and must be selected and sourced to suit the site conditions and substrate.
Concrete footings: When installing Future Fence posts, a general-purpose concrete mix or Post Set Mix should be used. The use of quick or rapid-set concrete mixes is not recommended by the manufacturers of these products due to the risk of corrosion risk with aluminium. Use of accelerated mixes such as Quick Set or Rapid Set concrete (or similar) with Future Fence production will void any warranty claims.
Powdercoat: Future Fence products are powdercoated using the DGL/Dulux Protexture range.
All powder-coated finishes are subject to normal batch variation in colour, texture, and gloss level. These variations are inherent to the powder coating process and may occur between production runs or when coatings are applied by different powder coaters. While Future Fence takes care to maintain colour consistency, exact matching between batches or to previously supplied products cannot be guaranteed. Minor differences in appearance do not constitute a defect.
Swing Gates: When installing swing gates, including double gates, it’s important to consider structural load and post support to avoid failure over time.
Please note:

Future Fence Gate Kits do not arrive pre-assembled.

Hinges and Hardware are not pre-installed on gates.

No individual gate leaf should exceed 1500mm in width (including the frames).

Future Fence has not assessed the suitability or structural capacity of existing substrates for post installation.

It is the responsibility of the Customer and/or installer to determine the appropriate fixing method and ensure any existing substrate is capable of supporting the applied loads.

Substrates such as single brick, blockwork that has not been core filled, timber, or lightweight cladding may not be suitable for hinging or latching a gate without additional reinforcement.

If there is any uncertainty about the suitability of the existing substrate, where possible hinge gates off new inground posts in appropriate size footings.

Gate and post installations should be periodically inspected and maintained to ensure ongoing stability, safety and performance.

Future Fence accepts no liability for damage or failure arising from unsuitable substrates, incorrect fixings, or site-specific installation practices.
5. Pool Fencing
Future Fence panels and gates that are 1200mm or higher have been assessed by a NATA-accredited engineering facility as compliant with the dimensional and strength requirements of Australian Standard AS1926.1 for pool safety barriers.
However, compliance is not solely determined by the product - it is also affected by site-specific and installation-specific factors, including but not limited to:

Proximity to other structures or boundaries
State and local governments may also impose additional requirements or interpretations of the standard, which can vary by council or jurisdiction.
To ensure a smooth certification process, Future Fence strongly recommend engaging a licensed pool safety certifier during the planning stage to confirm that your installation will meet all applicable compliance and approval requirements. Future Fence does not provide and is not responsible for site specific advice.
Installers should keep the following non-exhaustive list in mind when installing pool fencing:
Fence Height & Gaps

Fences must be a minimum of 1200mm high measured vertically from finished ground level to the top of the barrier.

The maximum gap between the bottom of the barrier and finished ground level is 100mm.

The fence must be built on solid, stable ground.
Pool Gates
-
Must not open towards the pool.
-
Must be self-closing from any open position.
-
Must self-latch automatically upon closing.
Gate Latches

The latch release must be at least 1500mm above finished ground level or 1400mm above the top of the lower horizontal rail:
Gate Hinges

Hinges must be at least 900mm apart, measured from the top of the lower hinge to the top of the upper hinge, or:

If hinges are closer than 900mm, the bottom hinge must have a 60-degree safety cap or shield to prevent climbing.
6. Reservation of Stock
Future Fence cannot reserve or hold stock without a valid deposit. A deposit of at least fifty percent (50%) of the quoted amount is required to secure stock unless otherwise agreed in writing.
Stock availability communicated at the time of quoting is indicative and subject to change without notice. Future Fence cannot guarantee that stock will remain available between the time of quoting and receipt of payment. If stock becomes unavailable, Future Fence will notify the Customer and discuss alternative options or revised lead times.
7. Payment Terms & Ownership
Payment must be made in full prior to collection or delivery of goods. All goods remain the property of Future Fence until payment is received in full. All quoted prices include Goods and Services Tax (GST) at the applicable rate.
Risk in the goods passes to the Customer upon collection or delivery, whichever occurs first.
8. Claims of Defective Goods
Any claim that goods are defective or not in accordance with these terms must be made in writing within twenty-four (24) hours of collection or delivery. Claims must include photographs or video clearly showing the alleged defect and be sent to info@futurefence.com.au.
If no claim is made within this period, the goods are deemed accepted by the Customer.
9. Delivery & Collection
Warehouse Pickup: Customers will be notified when orders are ready for collection, typically within two to three business days of ordering. Customers must ensure they have appropriate transport and strapping. Future Fence is not liable for any damage that may occur to the product or personal injury to the Customer or connected parties during loading or transport. All Warehouse Pickups must be collected within one (1) week of notification unless otherwise agreed. Future Fence reserves the right to charge storage fees on palletised orders at a rate of $50 per day for orders not collected within seven (7) days.
Local Delivery: For addresses within 130km of Brisbane, deliveries are generally made using Future Fence vehicles. The Customer or representative must be on-site during the agreed delivery day to assist with unloading. If no one is present, the order may be returned to the warehouse and re-delivery fees will apply. Risk passes to the Customer upon delivery. Future Fence is not liable for any product damage, property damage or personal injury that may occur during unloading.
Freight to Door: Orders delivered via third-party freight providers are subject to their delivery schedules and terms. Customers must be present to receive and assist with unloading. Orders are shipped on pallets, which must be disposed of by the Customer. Once collected by the freight carrier, all risk transfers to the Customer.
Estimated delivery timeframes are estimates only and do not entitle cancellation or compensation.
If low cost and fast turnaround is important (or the Customer cannot be home to accept delivery), Future Fence strongly suggest selecting a depot collection which is often faster, lower cost and can be collected at a time that suits the Customer.
Depot Collection: Orders delivered to a freight carrier depot are subject to their delivery schedules and terms. Once collected by the freight carrier, all risk transfers to the Customer. Orders must be collected as soon as possible after notification to avoid storage fees. Customers must ensure they have appropriate transport and strapping. Assistance with loading is not guaranteed, and the Customer assumes all risk of injury and damage during loading.
Important: In all cases, the Customer or its representative assisting with collection or unloading must be physically capable of lifting heavy and/or oversize items. Future Fence's panels may arrive packaged in sets of two (2) and may weigh up to 70kgs. These panels can be broken down to individual pieces halving this weight. The Customer must ensure (and is responsible for arranging) appropriate labour to assist with loading/unloading (as the case may be).
Delivery delays may occur during peak periods.
10. Warranty
Future Fence’s warranty policy can be found here: warranty page. Customers are encouraged to review the warranty policy before purchase.
11. Returns
Products may be returned within thirty (30) days of purchase, provided they are in their original, unmarked condition. Returns will not be accepted for goods that have been used, damaged, altered, or installed. Custom-made or made-to-order products are not eligible for return or exchange.
Customers may choose either a refund of the purchase price of the returned products or an exchange for alternative products of equal value.
Freight and shipping costs are non-refundable under this policy. The Customer is responsible for all return freight charges and must ensure goods are securely packaged to prevent damage during transit. Future Fence accepts no liability for goods lost or damaged in return freight.

Future Fence will advise the outcome of the claim within three (3) to five (5) business days of receipt of returned goods. If a refund is approved, it will be processed promptly and issued to the original payment method. Please allow seven (7) to ten (10) business days for the merchant to process the refund.
12. Validity
Quotations are valid for thirty (30) days unless otherwise stated. Prices and lead times may vary where scope, specifications, or quantities change after the quotation is issued.
13. Limitation of Liability
To the fullest extent permitted by law, Future Fence’s liability is limited to the replacement, repair or refund (partial or full) of defective goods. Future Fence shall not be liable for indirect, consequential, or incidental losses arising from use, installation, delay, or supply of its products.
14. Debt Recovery
All payments must be made in accordance with these terms. Overdue amounts will accrue interest at a rate of 10% per annum, calculated daily until payment is received in full. The Customer agrees to pay all costs incurred by Future Fence in recovering overdue amounts, including legal, mercantile, and administrative fees. Future Fence reserves the right to suspend supply or cancel orders for overdue accounts.
15. Force Majeure
Neither party is liable for default due to events beyond reasonable control, including but not limited to acts of God, war, terrorism, strike, lockout, fire, flood, drought, storm, COVID-related delays, or international shipping delays.
16. Invalidity and Applicable Law
If any provision is deemed invalid, void, illegal, or unenforceable, it does not affect the validity of the remaining provisions. All Goods are subject to Queensland laws, and Future Fence is not responsible for changes in the law affecting the supplied Goods.
Future Fence is not liable for any indirect loss or expense suffered by the Customer arising from a breach of these terms and conditions.
17. Acceptance of Terms
By accessing, browsing, or using this website, you agree to be bound by these Terms and Conditions, including any future updates. If you do not agree with any part of these terms, you must not use this website or place an order through it. Future Fence may update or amend these Terms and Conditions at any time without prior notice.
